§ 2.1 Controller: CanvasCodeDesign, 30966 Göttinger Str. 97 Hemmingen, Germany, is the data controller for personal data processed through this website. Reach the controller at [email protected].

§ 2.2 Categories of Data: We process identification and contact data you enter on the work-order form (name, e-mail, phone, company), project parameters you disclose in scope remarks, and technically necessary log data (IP address, user agent, timestamp, requested URL) required to deliver and secure the website.

§ 2.3 Purposes & Legal Bases: Contact data is processed to answer your requisition and prepare a quotation (Art. 6(1)(b) GDPR — pre-contractual measures). Contract data is processed to deliver a purchased service (Art. 6(1)(b)). Log data is processed to defend against abuse and maintain availability (Art. 6(1)(f) — legitimate interest). Storage-consent flags are processed on the basis of Art. 6(1)(f) or Art. 6(1)(c) where applicable.

§ 2.4 Recipients: Data is shared only with processors bound by contract — hosting and e-mail providers operating under data-processing agreements — and with public authorities where we are legally compelled. We do not sell, rent, or broker personal information.

§ 2.5 Retention: Requisition correspondence is retained for the duration of negotiations plus the statutory commercial retention period (generally six to ten years under German law). Technical logs are rotated within thirty days unless a security incident requires longer preservation.

§ 2.6 Your Rights: You may request access, rectification, erasure, restriction, and portability of your data, and you may object to processing based on legitimate interest (Art. 21 GDPR). Where processing rests on consent, you may withdraw it at any time for the future. You may lodge a complaint with a supervisory authority — for our seat, the competent authority of Lower Saxony.

§ 2.7 CCPA / US Notice: Residents of California and other US states with comparable privacy statutes may request disclosure of the categories of personal information collected, may request deletion, and may opt out of any “sale” or “sharing” of personal information. CanvasCodeDesign does not sell personal information. Requests may be sent to [email protected] and will be answered within the periods required by applicable law.

§ 2.8 International Transfers: Where a provider processes data outside the European Economic Area, transfers rely on adequacy decisions or Standard Contractual Clauses together with supplementary technical measures.

§ 3.1 Formation of Contract: A binding engagement arises when CanvasCodeDesign issues a written quotation referencing a work-order and the client confirms acceptance, or when the client pays an issued invoice. Informal enquiries through the requisition form are non-binding.

§ 3.2 Scope & Change Control: Deliverables, price figures, and turnaround windows are those stated in the accepted quotation. Additional requests outside the declared scope are quoted separately before work begins; declared tolerances (typically ±2 business days) accommodate ordinary review cycles.

§ 3.3 Client Duties: The client supplies content, assets, and access credentials in a timely manner and reviews drafts within the agreed review windows. Delays in client feedback extend turnaround day-for-day.

§ 3.4 Fees & Payment: Prices are quoted in USD or EUR as stated and exclude applicable value-added tax unless noted. Invoices are due within fourteen days of receipt unless otherwise agreed. Late payment may incur statutory default interest and suspension of open work. Secure settlement is available through the Pay channel in the navigation.

§ 3.5 Intellectual Property: Upon receipt of full payment, the client receives the rights to the client-specific final deliverables agreed in the quotation. CanvasCodeDesign retains rights to pre-existing tools, methods, templates, and generic know-how, and may display non-confidential work in its portfolio unless the client objects in writing.

§ 3.6 Third-Party Materials: Fonts, stock assets, and libraries remain subject to their own licenses. The client is responsible for ongoing license fees where licenses transfer as subscriptions.

§ 3.7 Liability: We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For ordinary negligence, liability is limited to breach of essential contractual duties with foreseeable average damage, except where mandatory statutory liability (including product liability) applies unchanged.

§ 3.8 Termination: Either party may terminate for good cause. On termination, completed work up to the cut-off is invoiced proportionally; prepaid fees for unstarted phases are refunded under § 5.0.

§ 3.9 Dispute Resolution: The European Commission provides a platform for online dispute resolution. We are willing to participate in consumer arbitration procedures where required by law; otherwise the courts of Hannover, Germany, have exclusive jurisdiction for merchants.

§ 4.1 What We Store: This website stores a single functional flag in your browser’s localStorage under the key cookie_accepted when you activate the notice button. The flag records that you have acknowledged the cookie notice so it is not shown again on return visits.

§ 4.2 What We Do Not Set: CanvasCodeDesign does not set advertising, profiling, or cross-site tracking cookies on this site. No third-party advertising networks are embedded in the drawing set.

§ 4.3 Third-Party Embeds: The contact sheet embeds a Google Maps frame. Loading that frame may cause Google to set technically necessary cookies under Google’s own policies when the frame is displayed. The map loads lazily; you can avoid it by not opening the contact sheet if you prefer.

§ 4.4 Duration: The localStorage flag persists until you clear site data for this domain. It does not expire by itself and is not transmitted to us with each request.

§ 4.5 Management: You can remove the flag at any time through your browser’s site-data controls (clear localStorage / clear cookies & site data). Blocking storage entirely is also possible; the notice will then reappear on each visit, and the site remains fully usable.

§ 4.6 Legal Basis: Technically necessary storage that is strictly required to provide a feature you request (remembering the notice dismissal) rests on the telecommunications-telemedia exemption and, where consent frameworks apply, on your prior acknowledgment of the notice.

§ 5.1 Right of Withdrawal (EU Consumers): If you are a consumer within the European Union, you have the statutory right to withdraw from a distance contract within fourteen days of conclusion without giving reasons. To exercise this right, send an unequivocal statement to [email protected]. If performance has begun at your express request before the withdrawal period ends, you owe pro-rata value for services already rendered.

§ 5.2 Defect Remedies: Where delivered work deviates materially from the accepted specification, report the defect in writing within fourteen days of handover. We will cure the defect within a reasonable period. If cure fails twice for the same essential defect, you may reduce the price or terminate the engagement under the statutory rules.

§ 5.3 Cancellation Before Start: If you cancel a confirmed order before drafting has begun, prepaid amounts are refunded in full less any non-refundable third-party licenses already purchased in your name.

§ 5.4 Cancellation After Start: Once schematic or detailed work has begun, refunds cover the portion of the fee relating to phases not yet commenced. Completed phases remain payable; overpayments are returned within fourteen days of agreement on the cut-off.

§ 5.5 Monthly Retainers: Continuous layout retainers may be cancelled at any time with effect from the end of the current monthly period. Unused prepaid hours from the closing period are refunded pro-rata, or credited forward if you prefer.

§ 5.6 Non-Refundable Items: Bespoke third-party license fees, domain registrations, and external hosting charges already incurred are not refundable once ordered in the client’s name.

§ 5.7 Method of Refund: Approved refunds are issued to the original payment method within fourteen days of approval, without undue delay, via the same channel used for settlement wherever technically possible.
